1. Nature of the Service & Non-Commercial Status

By registering for or using Pillion, you explicitly acknowledge and agree that:

• No Commercial Carriage: Pillion facilitates non-commercial carpooling/bike-pooling between private individuals. Seat givers are commuting for their own personal or professional purposes and are not employees, contractors, or agents of Pillion.
• Strict Cost-Sharing Caps: Any financial contributions requested or paid through the platform are strictly limited to the proportional sharing of actual fuel and direct running costs. No user is permitted to generate profit, commercial revenue, or business income from pooling.
• No Surge Pricing: Fares are capped based on standard distance-based fuel consumption calculations for two-wheelers.

2. Eligibility and User Registration

To use Pillion, you must satisfy the following conditions:

• Age Requirement: You must be at least 18 years of age.
• Authentic Account: You must authenticate using your own verified Google account. You may not impersonate any person or create fictitious accounts.
• Voluntary Verification: Verification (Work Email, UIDAI Aadhaar Secure QR, and DL/RC review) is optional to browse, but is mandatory to obtain verified trust badges and to offer seats as a rider.

3. Safety Responsibilities & Conduct Rules

All members of the Pillion community must strictly abide by our Rider Safety Pledge and applicable traffic regulations:

• Mandatory Helmet Usage: Under Indian Motor Vehicles law and Pillion rules, both the rider and the pillion passenger must wear an ISI-certified helmet at all times during the ride.
• Single Passenger Limit (No Overloading): Two-wheelers are strictly limited to one rider and one pillion passenger. Triple riding or carrying unsafe cargo is strictly prohibited.
• Sobriety & Road Safety: Operating a vehicle or commuting under the influence of alcohol, drugs, or intoxicating substances is strictly prohibited and results in immediate permanent account termination.
• Vehicle Roadworthiness: Seat givers warrant that their two-wheeler is in safe operating condition, possesses a valid Registration Certificate (RC), valid third-party motor vehicle insurance, and a current Pollution Under Control (PUC) certificate.
• Valid Driving Licence: Seat givers must hold an active, non-expired driving licence authorizing them to ride two-wheelers in India (MCWG or MCWOG).

4. User Conduct & Zero Harassment Policy

We maintain zero tolerance for harassment, discrimination, hate speech, stalking, or inappropriate conduct of any kind. Respect fellow commuters' personal boundaries. Women-only matching preferences must be strictly respected. Any reported violation will lead to immediate suspension and review.

5. Account Suspension and Termination

Pillion reserves the right to immediately suspend or permanently terminate access to any user who:

• Submits altered, counterfeit, or misleading verification documents.
• Attempts to use the platform for commercial taxi operations, illegal carriage, or for-profit fare negotiation.
• Violates road safety rules or endangers another commuter.
• Engages in abusive, harassing, or threatening behaviour.

6. Limitation of Liability and Platform Disclaimer

Pillion provides a technology matchmaking platform on an "as is" and "as available" basis. To the maximum extent permitted by applicable Indian law:

• Facilitator Role: Pillion does not provide transportation services and does not inspect vehicles in person. Commuters travel voluntarily and assume mutual risks associated with urban road transit.
• No Common Carrier Liability: Pillion is not liable for road accidents, personal injuries, property damage, delays, traffic violations, or dispute resolutions arising between commuters during a shared commute.
• Emergency Routing: While Pillion provides an in-app emergency SOS trigger routing to the National Emergency Helpline (112) and alert emails, Pillion does not operate a 24x7 emergency call dispatch desk.

7. Intellectual Property & Brand

All logos, interface designs, trademarks, and software related to Pillion are the exclusive intellectual property of Toonshala (trading as Marsys Group) and its licensors. Unauthorized copying, decompilation, or scraping is strictly prohibited.

8. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
